GENERAL TERMS AND CONDITIONS OF SALE OF THE ONLINE STORE
Effective from: 2 August 2026
Preamble
La French Beauty S.A.S., a French simplified joint-stock company with share capital of €1,072, whose registered office is located at 27 rue Léopold Bellan, 75002 Paris, registered with the Paris Trade and Companies Register under number 977 850 478 (the “Platform Operator”), operates an online marketplace connecting Buyers with Sellers (the “Store”).
The Platform Operator acts as an intermediary and not as a seller and is therefore not responsible for Products sold through the Store.
For any questions, you may contact the Platform Operator’s customer service department using the Store’s dedicated online form.
1. Definitions
Each of the terms below shall have the following meaning in these General Terms and Conditions:
Buyer: any natural person who qualifies as a consumer within the meaning of the French Consumer Code (“any natural person acting for purposes outside their trade, business, craft, professional or agricultural activity”) and who has placed one or more Orders.
Store: the online store through which Products are purchased, accessible via La French Beauty’s website (or any domain that may replace it).
Order: the purchase of one or more Products by a Buyer through the Store, in return for payment of a fixed sum.
General Terms and Conditions: these general terms and conditions of sale.
Privacy Policy: the Platform Operator’s privacy policy, accessible here.
Products: the products offered for sale on the Store.
Sellers: any professional seller of Products on the Store.
2. Purpose
These General Terms and Conditions govern (i) the terms under which Products supplied by a Seller are sold to the Buyer and (ii) the Platform Operator’s role as an intermediary.
3. Acceptance and amendment of the General Terms and Conditions
- The General Terms and Conditions are provided to the Buyer during the Order process. They are also available on the Store at all times.
- By clicking the “Accept” button, the Buyer acknowledges having read and agrees to all provisions of the General Terms and Conditions that apply to them.
- Any Order or delivery of Products is subject to the Buyer’s unconditional acceptance of, and full compliance with, all provisions of these General Terms and Conditions.
- The applicable General Terms and Conditions are those in force on the date the Buyer places the Order.
- The Platform Operator reserves the right to amend the General Terms and Conditions, in whole or in part, at any time to reflect requirements and changes relating to the Products. New General Terms and Conditions shall apply only to Orders placed after their effective date, unless they have been notified by the Platform Operator and accepted by the Buyer.
- The Buyer represents that they have the legal capacity to accept the General Terms and Conditions and undertakes to comply with them.
- If the Buyer accepts the General Terms and Conditions on behalf of a legal entity, the Buyer represents that they have the necessary right and authority to do so.
4. Ordering procedures
4.1 Product and Service characteristics
- In accordance with Article L. 111-1 of the French Consumer Code, before placing an Order the Buyer may review on the Store the essential characteristics of the Products they wish to order. Photographs and graphic representations illustrating the Products are not contractually binding.
- Sellers are solely responsible for Product descriptions and for ensuring that Products comply with those descriptions. If a Seller modifies a Product, its graphic representation shall neither incur the Platform Operator’s liability nor affect the validity of the sale.
- Similarly, any difference in the appearance of a Product upon delivery resulting from a change in packaging shall not affect the validity of the sale or incur the Platform Operator’s liability.
- The Buyer may select one or more Products from the various categories offered on the Store.
- Offers displayed on the Store are valid while stocks held by Sellers last.
4.2 Order process
- A Buyer wishing to order Products offered on the Store selects the chosen Products and adds them to their basket. The Buyer repeats this process for each Product they wish to order.
- Before confirming the Order, the Buyer reviews their basket, which sets out the essential characteristics of the Products ordered. At this stage, the Buyer may amend the Order by removing or adding Products.
- If the Buyer decides to purchase the selected Products, after confirming the basket they will be asked to provide an email address, their identity and a delivery address, and to select a payment method.
- The information requested by the Platform Operator is collected and transmitted to the Seller for the proper delivery of the Products. The Buyer is therefore informed that all requested information must be duly provided before Products can be delivered.
- The information provided must be complete, accurate and up to date, which the Buyer warrants. If any information changes between the Order date and the Product delivery date, the Buyer undertakes to keep it accurate by notifying the Platform Operator of the necessary changes at least five days before delivery.
4.3 Payment
- Delivery of the Products is subject to the completion and validation of online payment of the price shown during the Order process on the Store.
- The Product price must be paid online through the Store using one of the payment methods displayed at checkout. The Platform Operator may refuse any request to use another payment method.
- Payments are securely processed by the payment service providers made available on the Store. They collect and receive payments in the name and on behalf of the relevant Seller.
- All Product prices displayed on the Website are inclusive of all applicable taxes and denominated in euros. Delivery charges are not included in the displayed Product prices and are shown separately before the Order is confirmed. Any change to the applicable VAT rate may be reflected in Product prices.
- Deliveries of Products outside France may be subject to taxes and customs duties. These duties and taxes relating to Product delivery are payable by and remain the sole responsibility of the Buyer. Sellers and the Platform Operator are not required to verify or inform Buyers of the customs duties and taxes applicable in the delivery country. The Buyer is advised to obtain information from the competent authorities in that country.
- The Seller reserves the right to change prices at any time, provided that only the price displayed on the Order date shall apply to the Buyer.
- At the payment stage, the Buyer may enter a gift code or discount code in their possession. The Platform Operator may refuse any invalid code or any other form of discount requested by the Buyer through the Store.
- Once payment details have been entered, the Buyer is asked to review and confirm the Order.
- Where payment in instalments is offered at checkout, it is provided by the third-party credit provider identified at that stage and is subject to that provider’s eligibility requirements and contractual terms. The applicable conditions and complaint procedure are presented to the Buyer before the payment option is confirmed.
5. Delivery
- Products may be delivered in France and, for eligible Products and Sellers, to the foreign countries made available at checkout. Available destinations, delivery methods and delivery charges are shown before the Order is confirmed.
- Products shall be delivered by the Seller to the address provided by the Buyer to the Platform Operator when placing the Order.
-
If any or all of the information required for delivery proves to be incorrect or incomplete, or if the Buyer fails to collect the parcel within the period specified by the carrier (in particular for delivery to a pick-up point), resulting in the carrier returning the Products to the Seller, the Buyer shall bear the related costs and consequences.
Once the parcel has been returned to the Seller:
- the Buyer may request that the Products be dispatched again, provided that the Buyer first pays all new delivery charges; or
- the Buyer may request cancellation of the Order. The Seller shall then refund the Product price to the Buyer, after deducting the actual delivery charges and, where applicable, any return charges invoiced to the Seller by the carrier.
The return of a parcel because it was not collected within the carrier’s time limit or because the address was incorrect does not in itself constitute exercise of the right of withdrawal defined in the “Right of withdrawal” section of these General Terms and Conditions.
- Delivery times and methods are specified by the Seller, who is solely responsible for complying with them. The Seller undertakes to comply with the stated delivery times, which may not be unreasonably delayed and may not under any circumstances exceed 30 days.
- In the event of a delivery problem, the Buyer is invited to submit a claim to the carrier and notify the Seller. At the Buyer’s choice, the Seller shall offer either to send again any undelivered or damaged Product(s) by means of a new delivery or to refund the price paid by the Buyer for the undelivered or damaged Products, together with any costs incurred in returning damaged Products to the Seller.
6. Right of withdrawal
- In accordance with the French Consumer Code, a Buyer who is a consumer has a right of withdrawal.
- The withdrawal period expires 14 (fourteen) calendar days after the day on which the Buyer, or a third party appointed by the Buyer other than the carrier, physically takes possession of the Products. Where several Products ordered together are delivered separately, or where a Product is delivered in several lots or items, the withdrawal period expires 14 (fourteen) calendar days after the day on which the Buyer physically takes possession of the final Product, lot or item.
- To exercise the right of withdrawal, the Buyer must notify the Seller of their decision to withdraw from the contract by means of an unambiguous statement (for example, a letter sent by post, fax or email). The Buyer may use the model withdrawal form in Appendix 1.
- The Buyer must return the Products in their original packaging without undue delay and no later than 14 calendar days after the day on which the Buyer notified the Seller of their withdrawal. The deadline is met if the Buyer sends the Products before the 14-day period expires.
- In the event of withdrawal, the Seller may withhold the refund until the Seller has received the returned Products or until the Buyer provides evidence that the Products have been sent back, whichever occurs first.
- The Seller shall refund all payments received from the Buyer in respect of the withdrawn purchase, including the standard delivery charges, no later than 14 calendar days after the day on which the Seller is informed of the Buyer’s decision to withdraw, subject to the Seller’s right to withhold the refund as stated above. Any additional cost resulting from the Buyer’s choice of a delivery method more expensive than the least expensive standard method offered shall not be refunded. The direct cost of returning the Products shall be borne by the Buyer. For the avoidance of doubt, the return of a parcel because the Buyer did not collect it within the period specified by the carrier (in particular for delivery to a pick-up point) does not constitute exercise of the right of withdrawal. In that event, the provisions of the “Delivery” section concerning uncollected parcels and/or parcels returned for a reason attributable to the Buyer shall apply.
- The Seller shall issue the refund using the same payment method used by the Buyer for the initial transaction, unless the Seller and the Buyer expressly agree to use a different method.
7. Obligations of the Parties
- The Buyer must carefully check the condition and conformity of the Products on the delivery date. The Buyer may then either (i) accept the Products if they appear to conform or (ii) refuse them if they are manifestly non-conforming (broken Products or incorrect Products).
- The Platform Operator shall process the Buyer’s personal data in accordance with its Privacy Policy.
8. Liability and warranties
- In its capacity as intermediary, the Platform Operator provides no warranty and shall not be liable for any modification, deterioration or alteration of the Products.
- If Products are out of stock, the Seller shall inform the Buyer within 24 business hours. The Seller shall offer to refund the price paid for the Products that cannot be delivered.
- The Seller shall issue the refund using the same payment method used by the Buyer for the initial transaction, unless the Seller and the Buyer expressly agree to use a different method.
- If the Buyer is a consumer within the meaning of the French Consumer Code, they benefit from the statutory guarantee of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code for two years from delivery of the Products. Subject to the conditions laid down by law, the Buyer is entitled to have the Product brought into conformity by repair or replacement or, where the statutory requirements are met, to obtain a price reduction or cancellation of the sale. The Buyer is not required to prove that the lack of conformity existed during the 24 months following delivery of a new Product.
- The Buyer may also invoke the warranty against hidden defects in the Products within the meaning of Article 1641 of the French Civil Code. The Buyer has two years from discovery of the defect to bring a claim against the Seller.
- In such a case, the Buyer may choose either cancellation of the sale or a price reduction in accordance with Article 1644 of the French Civil Code.
9. Force majeure
- Neither Party shall be liable where performance of any of its obligations is prevented or delayed by an event of force majeure, as interpreted by case law and defined in Article 1218 of the French Civil Code, including natural disasters, fires, acts, decrees, legislation, regulations or restrictions imposed by any government (including measures implemented during epidemics or pandemics), or failures or interruptions of telecommunications or electricity networks.
10. Retention of title
- Regardless of the actual delivery date, ownership of the Products shall pass to the Buyer only after full payment of all sums due in respect of the Products, including the purchase price, surcharges, interest, taxes and costs payable under the General Terms and Conditions.
11. Termination of the General Terms and Conditions
- In the event of a breach of applicable law, a breach of any obligation set out in the General Terms and Conditions, or more generally any failure to comply with them, the Platform Operator reserves the right to terminate the General Terms and Conditions after serving formal notice to remedy the breach which remains without effect for seven days.
12. Customer Service
- In the event of a complaint, the Buyer may ask the Platform Operator to put them in contact with the Seller.
- Any request made by the Buyer to the Platform Operator, regardless of its form or purpose, must be sent using the following contact details:
Customer service requests must be submitted using the contact form available on the Store.
Postal address: La French Beauty, 27 rue Léopold Bellan, 75002 Paris, France.
13. Severability
- If one or more provisions of the General Terms and Conditions are declared wholly or partly invalid for any reason by a final court decision, the remaining provisions shall continue in force.
14. Waiver
- Any failure by the Seller or the Platform Operator to enforce a right or provision of the General Terms and Conditions shall not be construed as a waiver of the right to enforce it subsequently.
15. Governing law and jurisdiction
- These General Terms and Conditions are governed by French law. They are translated from the original French version for information purposes. In the event of any discrepancy or difference of interpretation, the French version shall prevail, subject to any mandatory consumer-protection rules applicable in the Buyer’s country of residence.
- In accordance with the provisions of the French Consumer Code governing consumer dispute mediation, after first submitting a complaint to us and if the response received is unsatisfactory, the Buyer may refer the dispute free of charge to the following consumer mediator:
